Party Wall Agreement
A Party Wall Agreement in the UK is a legal requirement when you plan to carry out construction or renovation work that affects a shared wall or boundary with a neighboring property. It is governed by the Party Wall etc. Act 1996, which aims to prevent and resolve disputes between neighbors during construction work. Common examples of work that may require a party wall agreement include loft conversions, extensions, removing a chimney breast, or any excavation near a shared boundary.

When is a Party Wall Agreement Needed?
A Party Wall Agreement is necessary when an owner plans to undertake certain types of construction work that may affect a shared wall or boundary, as defined by the Party Wall etc. Act 1996. Common situations that require a party wall agreement include:
-
Loft Conversions: Altering a shared wall or party structure during the conversion.
-
Building Extensions: Excavating close to or building against a party wall, such as when extending into the garden.
-
Structural Alterations: Adding beams or cutting into a party wall to support a new structure.
-
Excavation Work: Digging foundations near the boundary line, particularly if the excavation will reach below the depth of a neighboring building's foundations.

Before starting any such work, you are legally required to serve a Party Wall Notice to your neighbors, informing them of your intended works. If your neighbors agree to the works, a simple agreement can be reached. If they dissent or do not respond within 14 days, you will need to appoint a Party Wall Surveyor to draw up a formal Party Wall Award.
